NLRB Dismisses Another Unfair Labor Practice Charge Filed by Teamsters Against Henry Ford Genesys Hospital

GRAND BLANC, Mich. — The National Labor Relations Board (NLRB) has dismissed another unfair labor practice (ULP) charge filed by Teamsters Local 332 against Henry Ford Genesys Hospital.
This marks the second ULP charge filed by the union related to the ongoing labor dispute that has been dismissed. A third charge was withdrawn, as well as large portions of a fourth charge. These actions reinforce the hospital’s position that the current nurses' strike is driven by economic factors, not unfair labor practices. The hospital expects the few remaining charges filed by the union to be dismissed as well.
In its latest decision, the NLRB rejected the Teamsters’ claim that the hospital improperly renegotiated a tentative agreement after specific wording changes were later made to its proposals. According to the NLRB's decision:
“While the Union asserts that the parties reached agreement on Article 20 terms, the evidence adduced is insufficient to establish an agreement was reached. As such, it cannot be established that the Employer reneged or regressed on any such agreement.”
It goes on to say:
“As there is no finding that the Employer committed an unfair labor practice as alleged, the allegations of this charge cannot serve as a basis to find that the Union’s strike is an unfair labor practice strike.”
Since contract negotiations began last year, Henry Ford Genesys Hospital has legally implemented a nursing contract that includes:
- Significant Wage Increases: Three separate wage adjustments totaling RN increases up to 13%, plus specific market adjustments to ensure competitive pay in the Genesee County area.
- Staffing Incentives: Financial incentives to support ideal staffing, including a 10% shift differential for overnights, a $2 per hour differential for weekends, and critical staffing pay.
- Ratios: A continued commitment to the same nurse-to-patient ratios established in the previous contract.
Henry Ford Genesys Hospital remains committed to reaching a fair agreement that supports nurses, protects patients, and strengthens local healthcare access. Throughout the negotiation and strike, the hospital has maintained safe, high-quality care, achieving its highest patient satisfaction scores in recent history. Additionally, in June, the 172 members of the Teamsters Local 332 Technical Unit at the hospital voted overwhelmingly to ratify their new employment contract.
